Website Design & Payment Plan Terms
The Ginkgo Tree Creative Studio
These terms apply to clients purchasing a Website Package (or similar website services) via a payment plan.
By proceeding with payment, the client agrees to the following:
1. Payment Plan
The total project fee is payable in the agreed amount of instalments (usually 12) billed monthly via Stripe.
Payments commence immediately upon subscription and continue monthly for the agreed term.
Failure to complete all instalments does not void the total fee.
2. Website Ownership During Payment Plan
Until all instalments have been paid in full, the website — including its design, structure, and underlying assets — remains the property of The Ginkgo Tree Creative Studio.
3. Access During the Project
The client will be granted access to the website during the payment period. This access does not constitute ownership of the website or underlying assets, until the full amount is received.
4. Transfer of Ownership
Once the final payment has been successfully received:
Ownership of the Squarespace website will be transferred to the client
5. Project Scope & Revisions
This package includes the website pages, features, and integrations agreed upon at the commencement of the project.
Minor revisions are included as part of the build process. Requests that significantly alter the structure, functionality, or scope of the website may require an additional quote.
6. Client Responsibilities
The client is responsible for providing timely access, content, images, approvals, and feedback required to complete the project.
Delays in providing these materials may impact delivery timelines.
7. Launch & Finalisation
A website is considered complete once it is launched and functioning as agreed.
8. SEO Disclaimer
While SEO best practices are implemented as part of this package, search engine rankings, traffic levels, and commercial outcomes cannot be guaranteed. These results depend on factors outside the studio’s control.
9. Third-Party Platforms
The website is built using third-party platforms including (but not limited to) Squarespace and Stripe.
The Ginkgo Tree Creative Studio is not responsible for changes, outages, pricing updates, policy changes, or limitations imposed by these platforms.
10. Squarespace Subscription & Domain Name
The project fee does not include the cost of the Squarespace subscription or domain name registration.
The client is responsible for purchasing and maintaining their own Squarespace subscription and domain name. The Ginkgo Tree Creative Studio will provide guidance and support to assist the client in setting these up correctly.
As a Squarespace Circle Member, The Ginkgo Tree Creative Studio can provide the client with a 20% discount on their annual Squarespace subscription for the first year only. This discount applies to the initial annual subscription and does not extend to renewals or additional services.
11. Non-Payment
If payments are missed, paused, or cancelled:
Work may be paused
Ownership transfer will not occur
The studio reserves the right to restrict access to the website until payments resume or the outstanding balance is settled
12. Completion
Project delivery or site launch does not alter the payment obligation.
The full payment plan remains payable regardless of when the project is completed or launched.
13. Acceptance of Terms
By proceeding with payment or subscription, the client confirms they have read, understood, and agreed to these terms.
