Performer Agreement

Thank you for being part of a performance presented by The Ginkgo Tree Creative Studio and/or Hidden Lanes. We are committed to creating memorable, high-quality experiences for our guests while fostering a supportive, professional, and welcoming environment for all performers.

By participating in a performance, event, workshop, or related activity, you acknowledge and agree to the following:

1. Engagement

  • Details of the performance, including date, time, location, duration, and any agreed fee or contra arrangement, will be provided separately in writing.

  • This agreement applies to all performances, rehearsals, promotional activities, workshops, and related engagements undertaken with The Ginkgo Tree Creative Studio and Hidden Lanes.

2. Performer Responsibilities

Performers agree to:

  • Arrive on time and be prepared for their engagement.

  • Conduct themselves professionally and respectfully toward guests, venue staff, fellow performers, and members of the public.

  • Notify us as soon as reasonably possible if they are unable to attend or if circumstances arise that may affect their participation.

  • Supply any information, biographies, photographs, or promotional materials requested for event marketing purposes.

  • Comply with all reasonable venue rules and safety requirements.

3. Cancellation

  • If a performer needs to withdraw from an engagement, they agree to provide as much notice as reasonably possible.

  • The Ginkgo Tree Creative Studio and Hidden Lanes reserve the right to cancel or amend an engagement due to unforeseen circumstances, venue requirements, force majeure events, illness, insufficient bookings, or circumstances beyond our reasonable control.

  • In the event of cancellation by The Ginkgo Tree Creative Studio or Hidden Lanes, any agreed fees already earned or incurred will be honoured where appropriate and as agreed in writing.

4. Fees and Payment

  • Any performer fees, honorariums, ticket allocations, or contra arrangements will be confirmed in writing prior to the engagement.

  • Unless otherwise agreed, payment will be made within 2 weeks of the performance/event.

  • Performers are responsible for any taxation obligations arising from payments received.

5. Equipment and Personal Property

  • Unless otherwise agreed in writing, performers are responsible for providing and maintaining their own equipment, costumes, and personal belongings.

  • The Ginkgo Tree Creative Studio, Hidden Lanes, and associated venues accept no responsibility for loss, theft, or damage to personal property.

6. Photography, Videography & Talent Release

The Performer acknowledges and agrees that The Ginkgo Tree Creative Studio, Hidden Lanes, their employees, contractors, and representatives may photograph, film, audio record, or otherwise capture the Performer during rehearsals, performances, promotional activities, and related events.

The Performer grants The Ginkgo Tree Creative Studio and Hidden Lanes a perpetual, worldwide, royalty-free licence to use, reproduce, edit, publish, distribute, and display their name, likeness, voice, image, photographs, video recordings, and audio recordings for promotional, marketing, educational, archival, editorial, and commercial purposes, including but not limited to:

  • Websites

  • Social media platforms

  • Printed marketing materials

  • Advertising and promotional campaigns

  • Media releases and publications

  • Future events and promotional activities

The Performer understands and agrees that no additional payment, royalties, or compensation will be payable for the use of these materials beyond any fees otherwise agreed upon in writing.

The Performer waives any right to inspect or approve the finished materials and releases The Ginkgo Tree Creative Studio and Hidden Lanes from any claims arising from the lawful use of such materials.

Where practical, The Ginkgo Tree Creative Studio and Hidden Lanes will endeavour to credit performers when sharing promotional material.

For performers under 18 years of age, this agreement must be accepted by a parent or legal guardian.

7. Health and Safety

  • Performers agree to advise us of any health, accessibility, or safety considerations relevant to their participation.

  • Performers participate at their own risk and agree to take reasonable care for their own health and safety, as well as that of others.

8. Independent Contractor Status

  • Unless otherwise agreed in writing, performers participate as independent contractors and are not employees, partners, or agents of The Ginkgo Tree Creative Studio or Hidden Lanes.

9. Privacy

  • Personal information collected as part of this agreement will be used solely for the administration of performances, communications, payments, and related promotional activities and will be handled in accordance with applicable Australian privacy laws.

10. Acceptance

By submitting this form and participating in an engagement with The Ginkgo Tree Creative Studio and/or Hidden Lanes, you acknowledge that you have read, understood, and agree to the terms outlined above.

You further confirm that:

  • You are at least 18 years of age, or have the consent of a parent or legal guardian.

  • You have the authority to enter into this agreement.

  • The information you provide is accurate and complete.

  • You agree to the Photography, Videography, and Talent Release provisions contained within this agreement.
