We’re thrilled to have you on board for the Ballarat Marathon. Emma Hall will be your liaison for the the lead up and event days. Please fill out the Performers Agreement below as soon as possible to confirm your attendance.

Ballarat Marathon – Performer Agreement

This agreement applies to all performers participating in the Ballarat Marathon entertainment program coordinated by The Ginkgo Tree Creative Studio.

By agreeing to this form, the performer confirms they understand and accept the following conditions.

1. Independent Performer

The performer is engaged as an independent contractor, not an employee of The Ginkgo Tree Creative Studio or the Ballarat Marathon organisers.

The performer is responsible for their own equipment, transport, and preparation unless otherwise agreed in writing.

2. Safety Requirements

The Ballarat Marathon is a large public event involving runners, spectators, and road closures.

For safety reasons, performers must:

• follow all directions from event staff, race marshals, and volunteers
• remain within the allocated performance area
• keep all equipment, cases, and cables clear of runner lanes and public pathways

If a marshal or event official requests a change for safety reasons, the performer agrees to comply immediately.

3. Arrival and Setup

Performers must arrive at the agreed time to allow for safe setup before or during race operations.

All equipment and belongings must remain within the designated performance space and must not obstruct runners, spectators, emergency access, or event operations. No vehicle access is allowed on the race course.

4. Weather Conditions

This is an outdoor event.

Performances may be modified, relocated, delayed, or cancelled due to:

• weather conditions
• safety concerns
• race operations
• directions from emergency services or event organisers

The performer agrees that such decisions may be made at short notice in the interests of safety. Please check the performance schedule for your wet weather plan.

5. Equipment Responsibility

Performers are responsible for their own instruments, equipment, and personal belongings.

The Ginkgo Tree Creative Studio and the Ballarat Marathon organisers are not responsible for loss, theft, or damage to performer equipment unless required by law.

6. Insurance

Performers must hold their own suitable public liability insurance and upload the certificate of currency below.

School bands - Public liability insurance is typically covered by the school or governing education body. In this case, there is no need to upload a certificate; however, a supervising teacher must be present at all times.

7. Schools and Youth Performers

Where performers are students or minors, the school or organisation must provide an appropriate supervising teacher or responsible adult who remains present during the performance period.

Responsibility for student supervision and safety remains with the school or organisation.

8. Photography and Promotion

The Ballarat Marathon organisers, sponsors and The Ginkgo Tree Creative Studio may photograph or film performances for event promotion, media coverage, or future marketing.

By participating, performers consent to reasonable use of images or video from the event.

9. Assumption of Risk

Outdoor public events involve inherent risks, including uneven ground, weather conditions, and large crowds.

By participating, the performer acknowledges these risks and agrees to take reasonable care for their own safety and the safety of others.

10. Agreement

By submitting the performer registration form and selecting the agreement checkbox, the performer confirms that they:

• have read and understood this agreement
• agree to follow event safety directions
• agree to participate under these conditions
