Introduction
Thank you for working with The Ginkgo Tree Creative Studio.
This agreement outlines the terms of your engagement as an independent contractor for one or more projects produced by The Ginkgo Tree Creative Studio or its associated brands, including Hidden Lanes Slow Travel.
By accepting this agreement, you acknowledge that you have read and understood the following terms.
1. Nature of Engagement
You are engaged as an independent contractor and not as an employee.
Nothing in this agreement creates an employment relationship, partnership or joint venture.
You are responsible for your own taxation, superannuation, insurance and any other obligations required by law.
2. Scope of Engagement
The specific event details, dates, fees, location and services will be confirmed separately in writing (email, booking confirmation or engagement confirmation).
3. Professional Conduct
You agree to:
arrive punctually
present yourself professionally
perform the agreed services to a professional standard
comply with reasonable venue and safety requirements
treat guests, clients and fellow contractors respectfully
avoid behaviour that could damage the reputation of the organiser or venue.
4. Event Photography & Video
The Ginkgo Tree Creative Studio and its clients regularly photograph and film events.
By accepting this agreement, you acknowledge that photographs, video and audio recordings may capture your performance or participation.
Unless otherwise agreed in writing, you grant The Ginkgo Tree Creative Studio and its associated brands a non-exclusive, royalty-free, ongoing licence to use this material for legitimate business purposes, including:
social media
websites
printed marketing
advertising
grant applications
promotional videos
media releases
portfolios
tourism marketing
future event promotion.
This licence does not transfer ownership of your original creative works.
If you have any concerns regarding photography or filming, please discuss them with us before the event.
5. Intellectual Property
Unless otherwise agreed:
You retain ownership of your own original music, performances or creative works.
Any commissioned work is governed by the specific written agreement for that project.
The organiser may use photographs and recordings of the event as described above.
6. Cancellation
If you are unable to attend due to illness or emergency, you agree to notify us as soon as reasonably practicable.
If the organiser cancels an event due to circumstances beyond its control (including severe weather, venue closure, government restrictions or emergencies), we will work with you in good faith regarding rescheduling or payment according to the agreed engagement.
7. Safety
You agree to follow all reasonable health and safety directions from:
the venue
event organiser
emergency services.
You are responsible for ensuring any equipment you provide is safe and suitable for use.
8. Insurance
Where applicable, you warrant that you hold any licences, qualifications or insurance reasonably required to provide your services.
9. Payment
Payment will be made according to the agreed engagement details.
Where an invoice is required, payment terms are:
14 days from receipt of a valid tax invoice (or whatever terms you normally use).
10. Confidentiality
Any confidential business information shared before, during or after the engagement should not be disclosed without permission.
11. Privacy
Personal information collected is used solely for administering engagements, payments and event management and will be handled in accordance with applicable Australian privacy laws.
12. Limitation of Liability
To the extent permitted by law, The Ginkgo Tree Creative Studio is not liable for indirect or consequential loss arising from the engagement.
Nothing in this agreement excludes rights that cannot legally be excluded under Australian Consumer Law.
13. Acceptance
By signing below or submitting the accompanying online form, you confirm that:
you have read this agreement;
you understand these terms;
you agree to be bound by them.
